These terms cover the DockLift product and service only. Custom software and implementation work is covered by a separate written agreement.

The short version

A convenience, not a safety system
Your remote and your lift's own controls remain the things you rely on.

Never move your lift unless you can see it
The app cannot see your boat, and never claims to.

We keep the least we can
Who you are, which lift is yours, and a record of commands sent. We do not sell any of it.

Payments go directly to Stripe.
Who you are agreeing with
DockLift is provided by Cornamusa LLC, a Florida limited liability company. In these terms, "we", "us" and "Cornamusa" mean Cornamusa LLC. "You" means the person who holds the DockLift account.
By creating an account or using DockLift, you agree to these terms. If you do not agree, do not use it — your lift's remote and its own controls work exactly as they always have.
Safety — please read this part
A boat lift moves several tons of boat. DockLift sends the same radio commands your remote sends, over the internet, through equipment we install at your dock.
What that means in practice:

The app does not know where your lift is
There is no position sensor anywhere in the system. The app can tell you a command was sent. It can never tell you the lift moved, stopped, or reached the top — and it is written never to claim otherwise.

Only operate the lift when you can see it
Not from the car park, not from home, not on a camera. If you cannot see the boat and the water, do not press anything.

Anything between you and the lift can fail
Your phone signal, the marina's internet, our equipment, mains power — any of them. Your remote and the lift's own controls depend on none of it, which is why we never ask you to give them up.

Nobody else should be near the lift when it moves
That remains your responsibility, exactly as it is when you use the remote.

Anyone you invite can move your lift
Giving someone access gives them the same Raise, Stop and Lower you have. You can remove their access at any time, and we tell them when you do.
What we provide
A one-off installation of equipment at your marina, and a monthly service that lets your phone reach it. Prices are shown before you pay and don't change without notice. You can cancel any time; service continues to the end of the month you've paid for. Installed equipment stays ours unless we've agreed otherwise in writing, and we'll arrange collection if you stop.
If a payment fails we'll tell you and give you a month to fix it before the service stops. Your remote is unaffected by any of that — a billing problem never stops you moving your own boat.
Using it properly
You agree not to:

Operate a lift you don't have the right to operate
Only your own, or one whose owner has invited you.

Give your password or account to someone else
Invite them properly instead — it takes a moment and it means you can remove them again.

Interfere with the equipment or the service
No tampering with the installed hardware, no attempting to reach other people's lifts, no automated hammering of the service.

Use it as a safety or emergency system
It is a convenience. It is not rated, certified, or designed for anything anyone's safety depends on.
We can suspend or close an account that does any of these, or that hasn't paid, and we'll tell you why.
Warranty
We provide DockLift with reasonable skill and care, and we'll fix faults we're responsible for. Beyond that, and to the fullest extent the law allows, the service is provided "as is" without other warranties — including any implied warranty of merchantability or fitness for a particular purpose.
We do not warrant that the service will be uninterrupted, that a command will always arrive, or that your marina's network or power will be available. Some states do not allow certain warranty exclusions, so parts of this may not apply to you.
Liability
We are not liable for damage or injury arising from operating your lift, including where the app, our equipment, or a network fails. Use it the way you would use the remote: watching.
Except where the law does not allow it, our total liability to you for any claim relating to DockLift is limited to the greater of the amounts you paid us in the twelve months before the claim, or $500. We are not liable for indirect or consequential losses — lost time, lost use of your boat, or lost income.
Nothing here limits liability that cannot be limited by law, including for personal injury caused by our negligence, fraud, or gross negligence.
If something goes wrong between us
Email us first — [email protected]. Most things are a misunderstanding and we would rather fix it than argue about it. If we can't resolve it within 30 days, either of us may take it further.
These terms are governed by the laws of the State of Florida, and any dispute will be brought in the state or federal courts of Broward County, Florida. You may always bring a qualifying claim in small claims court.
Things that keep the rest working

If one part is unenforceable, the rest stands
A court striking any sentence here leaves everything else in force, and that sentence is narrowed to what the law does allow rather than removed entirely.

Events outside anyone's control
We are not responsible for failures caused by storms, outages, loss of internet at the marina, or anything else we could not reasonably control.

We may transfer this agreement
If Cornamusa is sold or reorganised, these terms move with it. Your rights do not change. You cannot transfer your account to someone else — invite them instead.

This is the whole agreement
For DockLift, this page is it, unless we have signed something else with you in writing.
What we know about you
Only what the product needs to work:

Your name and email
To sign you in and reach you.

Your password
Stored scrambled with a one-way hash. We cannot read it, which is why a lost password is reset, never looked up.

Which lift is yours
And who you've given access to.

A record of commands
What was sent, by whom, when. This is how you can see who moved your lift, and how we investigate a fault.

Whether your equipment was reachable
Sampled periodically, so we notice an outage before you do.

Anything you write to us
When you ask for help.
We do not track your location, read your contacts, or use your camera or microphone. There is no advertising in DockLift and no third-party analytics watching you use it.
DockLift is sold and operated in the United States and is not directed at anyone outside it. It is not for children under 13, and we do not knowingly collect their information.
Who else touches it
Four companies, each doing one job:

Stripe
Payments. Your card details go straight to them; they never reach us.

Resend
Sends the emails we send you.

Cloudflare
Carries traffic between your phone and your marina's equipment.

Supabase
Hosts our database.
We do not sell your information. We share it with no one else unless the law requires it, or you ask us to.
If we ever have a breach
If your information is exposed in a way that could put you at risk, we will tell you — by email, without undue delay, and in any event as required by Florida law. We will say what happened, what was affected, and what we are doing about it. We would rather tell you early and be wrong about the severity than tell you late.
How long we keep it
Your account and its command history stay while you're a customer. Ask us to delete them and we will, within 30 days, except where we're required to keep billing records. Command history for a lift you no longer own is deleted with the account.
Your side of it
Ask us for a copy of what we hold, ask us to correct it, or ask us to delete it: [email protected]. We'll reply within 30 days. You don't need a reason and it costs nothing, and we will never treat you differently for asking.
Changes
If we change anything that affects you meaningfully, we'll email you before it takes effect rather than quietly updating this page.
